Welcome to Tempo: Dialed In ("Tempo", "we", "us", or "our"). These Terms of Use ("Terms") govern your access to and use of the Tempo mobile application and related services (collectively, the "Service"). Please read these Terms carefully before using the Service.
By creating an account, downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

Tempo Pro is our premium subscription tier priced at $4.99 per month. Tempo Pro subscribers receive:
Tempo Pro subscriptions are billed on a monthly recurring basis. By subscribing to Tempo Pro, you authorize us to charge your payment method on file at the beginning of each billing cycle. All payments are processed through the Apple App Store, and you agree to Apple's payment terms and policies.
Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period. You can manage your subscription and turn off auto-renewal through your Apple ID account settings.
We reserve the right to modify subscription pricing at any time. Price changes will take effect at the start of your next billing cycle after we provide you with reasonable advance notice. Your continued use of Tempo Pro after a price change constitutes acceptance of the new pricing.
All subscription purchases are processed through the Apple App Store. Refund requests must be submitted directly to Apple in accordance with their refund policies. Tempo does not directly process refunds for App Store purchases. You may cancel your subscription at any time through your Apple ID account settings, and you will retain access to Tempo Pro features until the end of your current billing period.
Playgrounds are shared accountability groups where members can view each other's daily logs and progress. By creating or joining a Playground, you understand and agree that:
You are responsible for managing your Playground memberships and understanding what information you are sharing within each group.
TempoAI is an artificial intelligence assistant that analyzes your logged data to provide personalized insights, answer questions about your habits, and offer recommendations. By using TempoAI, you understand and agree that:
You retain ownership of all data and content you input into Tempo, including your habit logs, meal entries, sleep data, workout information, and any other personal information ("User Content"). By using the Service, you grant us a limited license to:
You are solely responsible for the accuracy and appropriateness of your User Content. You represent and warrant that you have the right to submit your User Content and that it does not violate any laws or third-party rights.
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy. By using Tempo, you consent to our collection and use of your information as described in the Privacy Policy.
We implement industry-standard security measures to protect your data, including health data imported from Apple HealthKit. We comply with Apple's HealthKit framework requirements for handling sensitive health information. However, no method of transmission or storage is 100% secure. You use the Service at your own risk.

The Service, including TempoAI insights and recommendations, is NOT intended to diagnose, treat, cure, or prevent any disease or medical condition, and should NOT be used as a substitute for professional medical advice, diagnosis, or treatment.
Sleep Tracking Disclaimer: Sleep data imported from Apple HealthKit and calculated sleep scores are for informational and tracking purposes only. They are not medical-grade measurements and should not be used to diagnose sleep disorders or other medical conditions. Consumer wearable devices like Apple Watch are not FDA-approved medical devices for sleep monitoring.
Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition, diet, exercise program, or sleep disorder. Never disregard professional medical advice or delay seeking it because of something you have read in Tempo or received from TempoAI.
If you think you may have a medical emergency or sleep disorder, call your doctor or emergency services immediately. Tempo and its operators are not responsible for any health issues that arise from following suggestions or insights provided through the Service.
The Service, including its software, design, graphics, text, and other content (excluding User Content), is owned by Tempo and is protected by copyright, trademark, and other intellectual property laws. The Tempo name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Tempo or its affiliates.
You may not use, copy, reproduce, modify, or distribute any portion of the Service without our express written permission. Your license to use the Service does not grant you any ownership rights to our intellectual property.
We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Reasons for termination may include, but are not limited to:
You may terminate your account at any time by contacting us or deleting the app. Upon termination, your right to use the Service immediately ceases. We may retain certain information as required by law or for legitimate business purposes.
Termination does not automatically cancel your Tempo Pro subscription - you must cancel through your Apple ID account settings to stop future charges. Revoking HealthKit permissions does not delete previously imported data from your Tempo account.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TEMPO MAKES NO WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF HEALTH DATA IMPORTED FROM APPLE HEALTHKIT OR CALCULATED BY WEARABLE DEVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TEMPO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO TEMPO IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless Tempo and its officers, directors, employees, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Illinois, and you consent to the exclusive jurisdiction of such courts.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the app or by sending you a notification. The "Last updated" date at the top of these Terms indicates when they were last revised.
Your continued use of the Service after changes to the Terms constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tempo regarding the Service and supersede all prior agreements, understandings, and communications, whether written or oral.
