Welcome to Tempo: Dialed In ("Tempo", "we", "us", or "our"). This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our mobile application and services (collectively, the "Service"). Please read this Privacy Policy carefully.

By using the Service, you agree to the collection and use of information in accordance with this Privacy Policy. If you do not agree with the terms of this Privacy Policy, please do not access or use the Service.

1. Information We Collect

1.1 Information You Provide to Us

When you create an account and use Tempo, we collect the following information that you voluntarily provide:

• Account Information: Your name, email address, username, and password when you register for an account
• Profile Information: Your profile picture or avatar initials, and user ID
• Habit Tracking Data: Information you log about your daily habits, including:
  • Meal logs and food intake information
  • Sleep data including duration and sleep quality scores
  • Workout and training activities
  • Custom habit tracking fields you create
  • Daily summaries and notes
• Playground Information: Playground codes, names, and membership information for accountability groups you create or join
• Communication with TempoAI: Questions you ask and conversations you have with our AI assistant
• Preferences: Your notification settings, reminder preferences, and customization choices
• Payment Information: Payment and billing information is processed through the Apple App Store and is subject to Apple's privacy policies. We do not directly collect or store your payment card information

1.2 Health Data from Apple HealthKit (iOS)

If you grant permission, we collect health and fitness data from Apple HealthKit on iOS devices:

• Sleep Analysis Data: Sleep duration, sleep stages (Core/Light, REM, Deep), in-bed time, and awake time recorded by Apple Watch or other connected devices
• Permission-Based Access: This data is only collected when you explicitly grant Tempo permission to access Apple Health sleep data
• User Control: You can revoke HealthKit permissions at any time through your device's Health app settings (Settings → Health → Data Access & Devices → Tempo), which will immediately stop data collection
• No HealthKit Data Sharing: Health data obtained through HealthKit is not shared with third parties except as necessary to provide the Service (e.g., storing in our secure database, processing through TempoAI)
• Apple's Policies: Our use of HealthKit data is subject to Apple's HealthKit framework terms and policies

Important: We only request read access to sleep data from HealthKit. We do not write any data to Apple Health. Sleep data imported from HealthKit is stored in our database and displayed in your Tempo app alongside manually logged data.

1.3 Information Collected Automatically

When you use the Service, we automatically collect certain information about your device and usage:

• Device Information: Device type, operating system version, unique device identifiers, mobile network information
• Usage Data: Features you use, time spent in the app, frequency of use, pages viewed, buttons clicked, and other interaction data
• Log Data: IP address, access times, app crashes, and performance data
• Analytics Data: Information about how you use the Service to help us improve functionality and user experience

1.4 Information from Third Parties

We may receive information about you from third-party services you choose to connect with Tempo, including:

• Apple HealthKit: Sleep analysis and health data (iOS only, with your permission)
• Authentication Services: Social login providers if you choose to use them
• Health and Fitness Apps: Other connected apps you authorize

We only collect information from third parties with your explicit consent and in accordance with their respective privacy policies.

2. How We Use Your Information

We use the information we collect for the following purposes:

• Provide the Service: To create and manage your account, enable habit tracking, facilitate Playground features, and deliver all app functionality
• Health Insights: To automatically import and display your sleep data from Apple HealthKit, calculate sleep scores, and track sleep stage patterns over time
• Personalization: To customize your experience, including generating personalized insights through TempoAI based on your logged data and imported health data
• Analytics and Insights: To display your statistics, streaks, activity charts, sleep quality trends, weekly insights, and other personalized analytics
• Communication: To send you important updates, security alerts, subscription information, and notifications you've opted into
• Service Improvement: To understand how users interact with Tempo, identify bugs, and improve features and performance
• Security: To detect and prevent fraud, abuse, security incidents, and other harmful activities
• Legal Compliance: To comply with legal obligations and respond to lawful requests from authorities
• Business Operations: To process payments, provide customer support, and manage subscriptions

3. How We Share Your Information

3.1 Sharing Within Playgrounds

When you join or create a Playground, your habit tracking data (meals, sleep, workouts, and other logged activities) becomes visible to other members of that Playground. This includes:

• Manually logged sleep data
• Sleep data imported from Apple HealthKit (if enabled)
• Sleep scores and sleep stage breakdowns
• All other tracked activities

This is a core feature of the accountability groups. You control which Playgrounds you join and can leave any Playground at any time to stop sharing your data with that group.

3.2 Service Providers

We may share your information with third-party service providers who perform services on our behalf, including:

• Cloud hosting and storage providers (such as Supabase for backend services)
• Analytics providers to help us understand app usage
• Payment processing services (Apple App Store)
• AI service providers that power TempoAI (such as Anthropic's Claude API)
• Customer support and communication tools

Important: Health data obtained from Apple HealthKit is treated with the highest level of security and is only shared with service providers necessary to deliver the Service (e.g., secure database storage, AI analysis). These service providers are contractually obligated to protect your information and may only use it to provide services to us.

3.3 Legal Requirements

We may disclose your information if required to do so by law or in response to valid legal requests, including to:

• Comply with legal obligations, court orders, or government requests
• Protect the rights, property, or safety of Tempo, our users, or the public
• Detect, prevent, or address fraud, security, or technical issues
• Enforce our Terms of Use and other agreements

3.4 Business Transfers

If Tempo is involved in a merger, acquisition, asset sale, bankruptcy, or other business transaction, your information may be transferred as part of that transaction. We will notify you of any such change and the choices you may have regarding your information.

3.5 With Your Consent

We may share your information for any other purpose with your explicit consent.

3.6 Aggregated and De-Identified Data

We may share aggregated or de-identified information that cannot reasonably be used to identify you. For example, we may share general statistics about user habits, sleep patterns, or app usage trends with partners or the public.

4. Data Retention

We retain your information for as long as necessary to provide the Service and fulfill the purposes outlined in this Privacy Policy. Specifically:

• Account Information: Retained until you delete your account
• Habit Tracking Data: Retained as long as you maintain your account to preserve your historical data and statistics
• HealthKit Sleep Data: Stored in our database and retained as part of your habit tracking history. Deleting your account will delete this data from our systems
• TempoAI Conversations: May be retained to improve AI performance, but personal identifiers are removed
• Usage and Analytics Data: Typically retained for shorter periods unless needed for security or legal purposes

When you delete your account, we will delete or anonymize your personal information within a reasonable timeframe, except where we are required to retain certain information for legal, security, or fraud prevention purposes.

Revoking HealthKit Access: If you revoke Tempo's access to Apple HealthKit through your device settings, we will no longer import new sleep data, but previously imported data will remain in your Tempo account until you manually delete it or delete your account.

5. Your Privacy Rights and Choices

Depending on your location, you may have certain rights regarding your personal information:

• Access: You can access your personal information at any time through your account settings
• Correction: You can update or correct your information through the app
• Deletion: You can request deletion of your account and associated data by contacting us
• Data Portability: You can request a copy of your data in a portable format
• HealthKit Permissions: You can manage Apple HealthKit permissions through your device's Health app settings (iOS Settings → Health → Data Access & Devices → Tempo)
• Opt-Out: You can manage notification preferences and opt out of promotional communications through app settings
• Playground Privacy: You can leave any Playground at any time to stop sharing your data with that group

6. Data Security

We implement appropriate technical and organizational security measures to protect your information against unauthorized access, alteration, disclosure, or destruction. These measures include:

• Encryption of data in transit and at rest
• Secure authentication and password protection
• Regular security assessments and updates
• Limited access to personal information by employees and contractors on a need-to-know basis
• Compliance with Apple's HealthKit framework security requirements for health data

However, no method of transmission over the internet or electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your information, we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials.

7. Children's Privacy

Tempo is not intended for use by children under the age of 13. We do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe your child has provided us with personal information, please contact us immediately, and we will take steps to delete that information from our systems.

If we discover that we have collected personal information from a child under 13 without proper parental consent, we will delete that information promptly.

8. International Data Transfers

Your information may be transferred to and processed in countries other than your country of residence, including the United States, where our servers and service providers are located. These countries may have different data protection laws than your country.

By using the Service, you consent to the transfer of your information to the United States and other countries where we operate. We take appropriate measures to ensure your information receives an adequate level of protection wherever it is processed.

9. Third-Party Links and Services

The Service may contain links to third-party websites, applications, or services that are not operated by us, including Apple HealthKit. This Privacy Policy does not apply to third-party services. We are not responsible for the privacy practices of third parties, and we encourage you to review their privacy policies before providing any personal information.

Apple HealthKit data is governed by Apple's privacy policies and terms. We comply with Apple's HealthKit framework requirements for handling health data.

10. California Privacy Rights

• The right to opt-out of the sale of your personal information (note: we do not sell personal information, including health data)
